The FIRs Filed By Delhi Police Over Mob Violence

It is now Day 5 since the violence unleashed in north east Delhi since the first clashes were reported on Sunday, 23 February.

Clashes intensified and peaked on 24 and 25 February as the US President was visiting India.

With the courts and the people coming down hard on the Delhi Police for their inaction in preventing or handling the violence, they have registered 30 FIRs (First Information Reports) so far.

The Lede has sourced the FIRs from a reliable source in the Delhi Police and we have compiled the details of the FIRs below in a chronological order.

The reader may note that we have compiled the list as per the date and time mentioned in the FIRs.

There are a number of discrepancies in the time of filing of FIR and the time of the incident taking place. For instance, in a few cases, the FIR has been filed at a time before the incident took place. Some dates are incorrect – for instance, one FIR is dated 20 February. This could well be a clerical error since the FIR numbers sequence shows that it is most likely to have taken place on 24 and 25 February. A few FIRs do not mention the time of filing or the time of incident either. It is also unclear as to when exactly the FIRs were filed.

We have changed the language in the FIRs to make them more readable but we have left the incoherent parts of the FIR in quotes since it is difficult to make sense of those portions.

We have also removed the names of the complainants (unless they are the police) and their addresses so as to protect their identity. The details of the sections have been provided as a table right at the end.

Here is the chronology of what happened in north east Delhi on 24 and 25 February as per the 30 FIRs registered by the Delhi Police.

FIR 1

Time: 13:00 hours

Police Station: Gokalpuri

Under Sections: 147, 148, 149, 436, 341, 427 IPC

What happened: According to this FIR, a call came in to the police control room regarding 2000 persons having iron rods and sticks blocking the road at Bhagirathi Vihar Pulia. ASI Manvir Singh reached the spot and found a gathering of about 200-250 people shouting slogans in support of CAA and they had blocked the road. They set some vehicles on fire.

Time: 19:42 hours

Police Station: Gokalpuri

Under Sections: 147, 148, 149, 436, 341, 427 IPC

What happened: A call came via police control room of bikes being set on fire and stone pelting at A-21, Main Road, Gokalpuri, near SBI bank. ASI Manvir Singh reached the spot and found a gathering of about 150-250 people shouting slogans in support of CAA and they had blocked the road. Few motorcycles set on fire were burning and some shops had been ransacked.

Time: 20:05 hours

Police Station: Gokalpuri

Under Sections: 147, 148, 149, 436, 341, 427 IPC

What happened: A call came via the police control room regarding shops being set on fire near Ambedkar College, Loni Gol Chakkar. ASI Sushil reached the tyre market near Kapoor Petrol Pump where he found that some tyre shops were set on fire. He found that 100-150 persons were present there shouting slogans in support of CAA and setting shops on fire.

Time: 00:00 hours

Police Station: Dayalpur

Under Sections: 147, 148, 149, 186, 341, 353, 332, 427, 34 and 323 IPC

What happened: Complainant XXX of Ghaziabad reported that bikes were being set on fire and stone pelting was taking place at Brijpuri, near Nala. Upon reaching the spot police found a group of 150-250 people chanting slogans in support of CAA who had blocked the road. Shops had been ransacked and a few motorcycles that had been set on fire were burning.

Time: 00:00 hours

Police Station: Dayalpur

Under Sections: 147, 148, 149, 186, 341, 353, 332, 427, 34 and 323 IPC & 3, 4 of PDPP Act

What happened: Complainant was XXX of Karawal Nagar. When police reached the spot around Sherpur Chowk, they saw that few vehicles and other public property were burned and there was stone pelting.

FIR 6

Time: 00:00 hours

Police Station: Khajuri Khas

Under Sections: 147, 148, 149, 186, 332, 353, 109, 114, 435, 427 and 34 IPC & 3, 4 of PDPP Act

What happened: CT Amit whose duty was at Khajuri Khas chowk with HC Anil and CT Bhupendra witnessed miscreants hurling stones and arson, damaging private and government property. He and other staff were trying to convince the miscreants but they were not listening to them. Their numbers were too high and the police were unable to control them. Around 2 am, a person threw something from the side of Shri Ram Colony, which hit CT Amit’s right hand and his hand started bleeding. CT Amit identified him when he came out and there were other men rioting with him.

Police Station: Welcome

Under Sections: 143, 144, 147, 148, 149, 323, 307, 302 IPC & 27 of Arms Act

What happened: Complainant reported that SI Amit and CT Nitin were in the Babarpur Metro Station where a crowd of many people had gathered. Some people in the crowd were instigating people to open fire and they were saying that those opposing CAA and NRC were “not doing well”. Police report that both had tried to convince the crowd but failed. The crowd became angry and began arson and ransacking in the market. The SHO with staff came to the spot and seeing them, the fierce crowd ran into the surrounding streets. But by this time the mob set fire. Meanwhile the police received information about GTB Hospital (Guru Tegh Bahadur Hospital) and they rushed there to find a 30 year old named Muddashri from Mustafabad brought dead. Another unknown victim was lying unconscious. The third victim was Ishak Khan, 24 years from Kabir Nagar who was unconscious and with a firearm injury. The fourth victim was one Yunus of Sunder Nagari, 32 years, who had sustained trauma injuries. The fifth victim was one Saif, 16 years, from Shri Ram Nagar. The sixth victim was SI Krishan Kumar, 59 years, who had been physically assaulted by the mob. The seventh victim was Asif, 26 years, with a firearm injury. The eighth victim was Rahul, 28 years, from Shahdra, who had a gunshot injury.

Police Station: Bhajanpura

Under Sections: 302 IPC & 27 of Arms Act

What happened: HC Karambir has given information from GTB Hospital that one person has been admitted by CT Dinesh. Patient’s name is Mubarkan Husain, 28 years, resident of Vijay Park. He was declared brought dead.

Time: 00:00 hours

Police Station: Welcome

Under Sections: 143, 144, 147, 148, 149, 323, 307 IPC & 27 of Arms Act

What happened: ASI Dharamir was in Shiv Mandir Babarpur where a crowd of many people had gathered. Some people were instigating the crowd to “stolen and fire” and “they are saying that those opposing CAA and NRC are not doing well. We both tried hard to convince them but failed.” The crowd became angry and indulged in arson and ransacking the market. SHO arrived with staff and the fierce crowd ran into the surrounding streets. The mob by this time had set fire.

FIR 10

Time: 00:00 hours

Police Station: Dayalpur

Under Sections: 147, 148, 149, 186, 353, 307, 332, 120B, 34 IPC

What happened: CT Deepak was on duty on Brijpuri Pulia. He saw that 1200-1250 rioters have burned some vehicles and public property. “And unknown person has been fired upon him and bullet injured his right leg and he got injured.”

FIR 11

Time: 00:00 hours

Police Station: Dayalpur

Under Sections: 147, 148, 149, 186, 353, 332, 427, 436, 34, 323 IPC & 3, 4 of PDPP Act

What happened: ASI Surender Pal got a call from the Police Control Room and he reached Brijpuri Pulia Masjid. He saw rioters (1000-1200) protesting against CAA and NRC. They pelted stones and damaged government and private property.

FIR 12

Time: 10:00 hours

Police Station: Khajuri Khas

Under Sections: 147, 148, 149, 380, 427, 435 and 436 IPC & 3, 4 of PDPP Act

What happened: ASI Jivanand received a call from Police Control Room from a caller at Gali No 4 in Khajuri Khas about riots. CT Rohtash was present there with other staff while 1000-1500 people had gathered there with sticks and iron rods. They were very angry and shouting slogans against CAA and NCR. The situation could be brought under control with the available staff. The mob started breaking into houses and vandalised them and burnt vehicles parked there. Rioters damaged private and government property.

FIR 13 (Dated 20/02/2020 but likely to be 25/02/2020)

Time: 12:00

Police Station: Sonia Vihar

Under Sections: 143, 147, 435, 436, 34 IPC

What happened: HC Sanjeev and CT Ankit were on beat patrol at 2nd Pusta Market, Sonia Vihar where a crowd of many people had gathered. Some people were instigating the crowd to “stolen and fire” and “they are saying that those opposing CAA and NRC are not doing well. We both tried hard to convince them but failed.” The crowd became angry and indulged in arson and ransacking the market. SHO arrived with staff and the fierce crowd ran into the surrounding streets. The mob by this time had set fire to two shops and an Omni car and ransacked some shops.

FIR 14

Time: 12:30 hours (likely to be 00:30)

Police Station: Bhajanpura

Under Sections: 144, 145, 147, 148, 149, 151, 186, 353, 332, 336, 436 IPC & 27 of Arms Act & 3, 4 of PDPP Act

What happened: HC Sanjeev Kumar reported that he arrived for arrangement duty at 12:30 and patrolling at MCD Court. There was a “heavy gathering of hundreds of people” shouting slogans against the CAA and NRC law and at the same time hundreds of people came towards Ghonda in favour of CAA and NRC and he saw that boys were coming at the same time in the hundreds. The SHO came with extra force and forcefully dispersed them. In the meantime public property was damaged.

FIR 15

Time: 13:13 hours

Police Station: Jyoti Nagar

Under Sections: 147, 148, 149, 427, 436 IPC & 3 PDPP Act

What happened: ASI Vijay Kumar received a call from Police Control Room at around 1.30 pm and he went to Gali No 05, Chappal Market at Ashok Nagar. He saw that rioters of around 200-250 in number had burned Molla Bakshi Masjid as well as some vehicles and public property.

Time: 13:30 hours

Police Station: Jyoti Nagar

Under Sections: 147, 148, 149, 302, 34 IPC

What happened: Complainant XXX, resident of Sushila Garden reported that at about 11 am, he and his friends AAA and BBB reached village Gokalpur near the flyover. At about 1.30 pm, after crossing pulia, they reached behind Ambedkar College service road nala. Suddenly a big rush of rioters came and he could not see AAA and BBB for some time. He heard noises of “paked liya paked liya” and after that the rioters had picked up BBB and “there were many brought gone on his forhead, mouth and stomach.” He was taken to GTB Hospital where the doctors declared him dead.

Police Station: Sonia Vihar

Under Sections: 143, 147, 149, 435, 436, 34 IPC & 3 of PDPP Act

What happened: HC Manoj and CT Ajay were on beat patrol at Milan Garden near Ram Rahim Masjid where a crowd of many people had gathered. Some people were instigating the crowd to “stolen and fire” and “they are saying that those opposing CAA and NRC are not doing well. We both tried hard to convince them but failed.” The crowd became angry and indulged in arson and ransacking the market. SHO arrived with staff and the fierce crowd ran into the surrounding streets. The mob by this time had set fire to “a car, a moped, a house and some wooden articles which were stored in an empty plot and ransacked electric meter and CCTV.

Time: 14:00 hours

Police Station: Jafrabad

Under Sections: 307, 186, 353 IPC & 25, 27 of Arms Act

What happened: At about 8 pm, HC Deepak Dahiya along with staff saw gathering of “about thousands of people” who were protesting against the Citizenship Amendment Act without any permission and they started doing “stolen plating”, firing on police party and hooting and after some time they started destroying public property.

Police Station: Bhajanpura

Under Sections: 147, 148, 149, 186, 353, 332, 436 IPC & 3, 4 of PDPP Act

What happened: ASI Ajay reported for arrangement duty. At about 3.30 am he received a message from SHO Bhajanpura that there was a “heavy gathering of boys” at C-12 Mod, 66 feet road, Yamuna Vihar. “He saw that boys were coming at the same time Hundreds of people shouting slogans they have damaged private and public property.”

FIR 20

Time: 16:00 hours

Police Station: Jafrabad

Under Sections: 141, 148, 149, 186, 353, 283, 332, 427, 307, 120B, 34 IPC & 25, 27 of Arms Act & 3, 4 PDPP Act

What happened: At about 8 pm, Inspector Leakhraj Singh and ACP along with other staff reached 66 feet road during patrolling at Maujpur, Jafrabad, Brahmapuri and Arvind Nagar. They saw “thousands” people gathered and doing protests against Citizenship Amendment Act without permission and they started doing “stolen plating”, firing on police party and hooting and after some time they started destroying public property.

Police Station: Dayalpur

Under Sections: 365, 302, 201, 34 IPC

What happened: A statement given by Ravinder Kumar, resident of Gali No 06, Khajuri Khas led to a case being registered. Ravinder Kumar’s son Ankit reached home around 5 pm from office and then went to get some goods from the market. He did not return home and a missing person’s complaint has been filed. His son was found dead in Chand Bagh Nala the next morning.

Time: 18:10 hours

Police Station: Khajuri Khas

Under Sections: 147, 148, 149, 380, 427, 435 and 436 IPC & 3, 4 of PDPP Act

What happened: ASI Jivanand received a call from Police Control Room from a caller at Gali No 8, E-Block in Khajuri Khas about “150 Muslim peoples” beating common men. 1000-1500 people had gathered there with sticks and iron rods. They were very angry and shouting slogans against CAA and NCR. The situation could be brought under control with the available staff. Mob broke into houses between Chandbagh Pulia and Lakhpat School and vandalised property and burned vehicles parked there. Rioters damaged private and government property.

Police Station: New Usmanpur

Under Sections: 141, 148, 149, 324 IPC

What happened: The complainant Raman, resident of Gautam Vihar, Delhi reported that he was going to purchase vegetables at 20:20 hours when he reached Gali No 5 when 15-20 people came from Phool Wali Masjid with “dande” and “talwar” who “called Allahu Akbar” and hit his face and foot and back side and they broke the shop and vehicle and ran away.

Police Station: Karawal Nagar

Under Sections: 147, 148, 149, 436, 427, 307 IPC read with 3 and 4 of PDPP Act

What happened: A call arrived at the police control room regarding a mob causing fire. ASI Hariom was despatched with staff and found stone pelting and firing by violent mob of particular religious group at Shiv Vihar 25 feet road. Several persons were injured.

FIR 25

Time: 21:00

Police Station: Karawal Nagar

Under Sections: 147, 148, 149, 436, 427, 307 IPC read with 3 and 4 of PDPP Act

What happened: A call was received from police control room at 11.30 pm from the hospital regarding admission of a patient from Shiv Vihar Pulia. ASI Hariom and staff reached there. SHO also reached. Mob of particular religious group at Shiv Vihar 25 feet road “was occurring”. Several persons were injured. The patient was unfit for statement and case.

Police Station: Jafrabad

Under Section: 302 IPC

What happened: Parvesh, 48 years, resident of Gali No 05 near Babu Ram Chowk, was admitted in hospital with bullet injuries and he died during treatment. Case registered.

FIR 27

Time: 23:30

Police Station: Bhajanpura

Under Sections: 147, 148, 149, 186, 307, 302 IPC & 27 of Arms Act

What happened: Complainant XXX, resident of Subash Mohalla reported that he was standing at the corner of the street at 11.30 pm along with his younger brother. At the same time there was a “heavy gathering in favour of CAA and NRC”. Some people started firing and threw stones. “Mehruf has gotten shot in the head and his neighbour Shamshad also got shot.”

Police Station: Khajuri Khas

Under Sections: 147, 148, 149, 302, 201, 435 IPC

What happened: CT Satender reported that when he was on patrol there were riots, arson, quarrel and vandalism in the police station area for several days. Many vehicles were burnt and overturned on Pusta Road. When the vehicles were checked closely in front of Kali Ghat road, near a burnt and overturned carriage, there were dead body like remains on the road. “It appears that someone has been burnt in the riots.”

What happened: Naresh Saini, 32 years, resident of Gali No 1, Brahmapuri has been admitted in hospital with bullet injuries. Case has been registered.

FIR 30

Police Station: Karawal Nagar

Under Section: 302 IPC

What happened: Information received from Guru Tegh Bahadur hospital that one Virbhan, 40 years, resident of Maujpur, was admitted with gunshot injury and subsequently died.
